This Indenture made and entered into this 18th day of August in the year of our Lord one thousand Eight hundred and thirty eight between Robert J. Browning of the County of Giles and State of Tennessee of the first part Hezekiah Jones of said County and State of the second part and Jeramiah Barnes of said county and State of the third part Witnesseth that whereas the said Robert J. Browning did on the 12th day of August 1838 Execute to Isaac Majors and Charles C. Abernathy administrators of the Estate of Robert Wells deceased his note in which the said Jeremiah Barnes is security for the sum of twenty one dollars due and payable on the 12th day of May 1837 and whereas the said Robert J. Browning being willing to and owing Jeremiah Barnes and to to him in case he should pay off said note as such security and possessing no other means whereby he can do has this indenture Witnesseth that for and in Consideration of the promises and the sum of one dollar paid by the said Hezekiah Jones to the said Robert J. Browning the receipt whereof is hereby acknowledged be the said Robert J. Browning doth bargain sell make over transfer and convey unto the said Hezekiah Jones his heirs and all his crop of cotton and corn now growing on the farm of which he lives and cultivates the present year to be cultivated by him and said Browning and when ripe to be gathered in and picked out and taken care of by him and so soon as gathered and picked out to be delivered to the said Hezekiah and require him to sell said crop of cotton and corn which he the said Hezekiah Jones doth bind himself to do and it is agreed upon between the parties that the said Hezekiah Jones shall upon said Barnes request advertise the sale of said corps of cotton and corn at Cross Water and Isaac Majors Black Smith Shop ten days before the day of sale and on said day of sale shall sell the same to the highest bidder either for cash or on credit at the election of the said Jeremiah Barnes or shall sell as much thereof as shall be sufficient to refund to the said Barnes any amount he may have paid as such security as aforesaid and it is further indentured and agreed to between the parties that if the said Robert J. Browning should fail or refuse to gather the above mentioned crops when ripe and secure them that in that case the said Hezekiah Jones shall have full power to secure the same and take possession thereof at the expense of said Robert J. Browning in Witness whereof the parties have hereunto set their hands and affixed their seals this day and date above written.
