This Indenture made and entered into this tenth day of November in the year of our Lord one thousand eight hundred and thirty five between Thomas Abernathy of the County of Giles and State of Tennessee of the one part, and Charles F. Haden of said County & state of the other part. Witnesseth, that the said Thomas Abernathy for ad in consideration of the sum of Eight hundred and dollars to him in hand paid the receipt whereof is hereby acknowledged, hath granted bargained & sold and by these presents do grant bargain Sale Convey & confirm unto said Charles F. Haden his heirs & a certain tract or parcel of land lying & being in said County of Giles & State of Tennessee on the South side of Elk river on Ragsdales Creek adjoining the State line, and County as follows, towit: Beginning at an elm, box elder and two hickories the south East corner of James Vanc one hundred acre tract, which corner is now bounded by Robert Hadens tract. The beginning of a four hundred acre survey, ______ from thence South nine degrees West to the South boundary line on State line, thence Eastwardly with the same to two dogwood the South East corner of said entry. Thence North to two black oaks in the Indian boundary line. Thence with said line to the beginning containing one hundred acres. To have and to hold the before recited land and bargained premises together with all and singular the rights profits hereditaments & appurtenances thereunto belonging or in anywise appertaining to the only proper use benefit and behoof of him the said Charles F. Haden, his heirs and assigns forever and the said Thomas Abernathy for himself his heirs __ doth covenant and agree to & with said Charles F. Haden his heirs and assigns that the before recited tract of land and bargained premises from the lawful claim or claims of all and eveyr persons or persons whatsoever, will warrant and forever defend, by these presents. In testimony whereof the said Thomas Abernathy hath hereunto set his hand and seal the day and date above written.
