PENSION FILES OF MOSES DANIEL BOONE HARVELL AND WIFE JULIA.

	Moses D. B. Harvell was on the roster of Clayton's Company, 30 Day 
      Volunteers, 	CSA.  "This company was raised at Ash Flat, Arkansas, 
      in response to Colonel 	Borland's call of November 5, 1861, mustered 
      into the Confederate service on November 	9, 1861, for 30 days, and 
      discharged on December 9, 1861, at Pitman's Ferry, Arkansas."  
	**{Additional service that Daniel did not share with the Bureau of 
      Pensions-RDH}

Items of note:
1. Daniel enlisted in Company E 3rd Missouri Calvary U.S. Volunteers August 1, 
      1862 at West Plains??, Missouri.  Left that unit without discharge in 
      Feb 1863.  The following account of a fellow member of the 3rd indicates 
      that it was combined with the 10th at approximately the time Daniel left:
	James S. Wilson enlisted at the age of 27, as a private in the Third 
      Missouri State Militia Cavalry, and was mustered in December 23, 1861, 
      at Mexico, Missouri...He obviously had strong 	feelings about the War, 
      enlisting in the United States Army just a few months after the first 
      shots were fired in Missouri at Camp Jackson in May.  He rose rapidly in 
      rank, proving himself to be an aggressive and able combat commander.  By 
      February 15, 1862, he had been promoted to First Sergeant.  He is listed 
      in the descriptive rolls of his Company as being promoted to Captain May 
	3, 1862.  The Tenth MSM was combined with the Third Missouri State 
      Militia on February 2, 1863, and designated the Third Missouri State 
      Militia Cavalry (New).   
2. Daniel enlisted in Company H 50th Missouri Volunteer Infantry on January 14, 
      1865, at Cape Girardeau, Mo, and was discharged (honorably) on August 5, 
      1865, at Benton Barracks, St. Louis, Missouri.
3. Daniel and Julia were married on June 17, 1866 by Steven Taylor, J. P. near 
      Lunenburg, Izard County, Arkansas.
4. Daniel died on August 18, 1900 near Oxford, Izard County, Arkansas.
5. Julia died on September 13, 1902.

DECLARATION FOR INVALID PENSION

On this 21st day of July A.D. one thousand eight hundred and ninety _ 
personally appeared before me, Clerk of the Circuit court; a court of record 
within and for the county and State aforesaid Moses D. B. Harvell aged 53 
years, a resident of Violet Hill, county of Izard, State of Arkansas, who, 
being duly sworn according to law, declares that he is the identical Moses D. 
B. Harvell who was enrolled on the 14th day of January 1865 in Co. H.  50th 
Reg. Int. Mo. Vol. as a private in the War of the Rebellion and served at 
least ninety days, and was Honorably Discharged at Benton Barracks St Louis 
MO on the 5th day of August 1865.  
That he is Wholey unable to earn a support by reason of Catarrh in the head, 
throat, and Lungs and also disease of Stomack and Bowels That said disabilities 
are not due to vicious habits, and are to the best of his knowledge and belief 
permanent.  That he has not applied for pension under application No.__. That 
he is not a pensioner under Certificate No ____.
That he makes this declaration for the purpose of being placed on the 
pension-roll of the United States under the provisions of the Act of JUNE 27, 
1890.
He hereby appoints L. C. WOOD & CO., U. S. Pension Attorneys, 512 F Street, 
N. W., Washington, D.C. his true and lawful attorneys to prosecute his claim, 
and he hereby agrees to allow said attorneys the lawful fee of Ten Dollars 
when his pension is allowed.  That his post office address is Violet Hill,

ON THIS 28 day of March A.D. 1891, personally appeared before me Clerk of the 
Circuit & County Courts in and for the aforesaid County, duly authorized to 
administer oaths Moses D B Harvell aged 53 years, a resident of Violet Hill 
in the County of Izard and State of Arkansas whose Post Office address is 
Violet Hill well known to be reputable and entitled to credit, and who, being 
duly sworn, declared in relation to aforesaid case, as follows, Claimant 
enlisted as a private in Co. E 3 Mo Cavaldry U S Vol on or about Aug 1st 1862, 
and left said command without discharge about Feby 1863 that afterwards, to 
wit in Jany 1865 he enlisted as a Volunteer in Co H 50th Mo Re'gt, and received 
an honorable discharge therefrom at the close of the war, in August 1865.  
Claimant further States that he rendered no Service prior nor after that 
mentioned above.

On this the 4 day of October A. D. one thousand eight hundred and 97 personally 
appeared before me a Notary Public within and for the county and State 
aforesaid Moses D B Harvell aged 6o years, residing in the County of Fulton, 
State of Arkansas ,who being duly sworn according to law, declares that he is 
a pensioner of the United States under the Act of June 27, 1890, and duly 
enrolled at the Knoxville Pension Agency, at the rate of 8 dollars per month, 
Certificate No. 834.999 for partial inability to earn a support by manual 
labor Catarrh in head , throat & lungs, disease of stomach & bowels.
That he was enrolled on the 14 day of January 1865 in Co. H 50 Reg't Mo Vols., 
in the service of the United States, in the war of the rebellion, and served 
at least ninety days, and was honorably discharged on the 5 day of August 1865 
at Benton Barracks St Louis Mo By reason of Being musterd out Sevis
That he believes himself to be entitled to an increase of pension on the 
grounds that the rate allowed him is too low and not commensurate with the 
extent of his present disability from Catarrh in head throat & Lungs disease 
of Stomach and Bowell and is not due to eny viscious habits 
That he has not applied for pensionn under eny Other law

That he has ___ been employed in the military or naval services of the United 
States prior to his Enlistment in above named Servis.
He therefore request that he be favored with another medical examination with 
the view of determining his right to $12 per month, the full rate allowed under

DECLARATION FOR WIDOW'S PENSION.

On this the 6 day of October , A.D. one thousand nine hundred and 1900 
personally appeared before me, a Notary Public within and for the county 
and State aforesaid, Julia A. Harvell aged 53 years, a resident of Vilet 
Hill Township, County of Izard State of Arkansas, who, being duly sworn  
according to law, makes the following declartion in order to obtain pension 
under the provisions of the act of Congress approved June 27, 1890, as 
amended by the act of May 9, 1900.
That she is the widow of Moses D. B. Harvell , who was Enrolled under the 
name of Moses D. B. Harvell at Cape Jeredo(sic) Missouri on the 14 day of 
January 1865 as a Private in Company H 50 Regiment of Infantry Missouri and 
honorably discharged on the 5 of August 1865, having served ninety days or 
more during the late war of the rebellion.  That the soldier was not in the 
military or naval services of the United States except as stated above.
That she was married under the name of Julia A. Vickery to said soldier at 
near Luning Burg, Ark on the 17 day of June 1866 by Steven Taylor J. P. ; 
that there was no legal barrier to the marriage; that she had not been 
previously married; that the soldier had not been previously married.
That the said soldier died the 18 day of August 1900 at Near Oxford Ark that 
she was not divorced from him; that she has not remarried since his death; 
and that she is without other means of support than her daily labor.
That the said soldier left the following named children who are now living 
and under sixteen years of age, to wit:
none under 16
That she has not heretofore applied for pension.
That her post-office is Oxford County of Izard State of Arkansas

one Cow and her little house hold goods nor did Moses D B Harvell own any real 
Estate at the time of his death therefore the widow did not have any real 
Estate to dispose off after the death of her husband there is no records in 
regard to Moses D B Harvell I further certify that I have no interest in the 
above action

I Mariah Mitchell {Moses D.B.'s sister} Do herby certify That I have bin 
acquainted with Jula A Harvill ever sence she was eight years Old also was 
acquainted with Moses D B Harvell all of his life and know that He and Jula 
A Harvell did not live together in eny way Prior to there marage in the year 
1866 and that Jula A Harvill is now only fifty five years and that they could 
not have lived together as man & Wife in the 1856 as Jula A Harvell was only 
Eight years Old at that time and further that nether One of them had bein mared 
Prior to thare marage to Each other and that they lived together as Husband & 
Wife till the Death of Moses D B Harvell and that neather one of them was never 
Dicvorced(sic) and further that I have no intrest in the Prosecution of this 
clame

{NOTE: If Mariah's statement is true that she knew her in 1855 (Julia 55 here 
in 1902 would have been 8 in 1855).

Dear Sir in Regard to Mistress Jula A Harvells application for Pension it 
Seames to me that it very dificult to get eny action on it Moses D B Harvell 
Served in the arma Had an Honorable Discharge Received a Pension up to his 
Death and as to his Prier Sevis Thare is no one hear knowes enything about it 
only that is was not Confederate Sevis the Rebels Run him and mey (sic many?) 
Others out of this country and that how they come to inlist in Other States
Now all Proofs has bein made that has ever ask for in Mistress Jula A Harvells 
Clame and I know that She is worthey and that needs her Pension Badly for She 
is feable and not able to earn a suport for the Self She made her application 
nearly 2 years ago and had no thought of Delay

Respectfully referred to chief Board Review with a view to Special Examination 
to determine soldier's prior service, marriage and non prior marriage of Either.  
This action is deemed necessary for the reason soldier alleged a prior service 
which Claimant cannot locate, and for the further reason there is no record of 
marriage, and the witnesses to same and non prior marriage sign by mark. Other 
points established Order 215 complied with. List of Comrades herewith-

This claim was referred to the S.E. Division for Special Examination to 
determine legal widowhood and soldier's prior service, and came to me for 
initial Examination.
On reaching Oxford today I was informed that the claimant had died.  I 
thereupon called upon her late physician to learn authoritatively the fact 
and date of death.  Said physician was not at home but I saw his brother who 
is also a physician and his partner, and who consulted his books and found 
that claimant died on Sept. 13, 1902.
Claimant did not claim for and left no children under 16 years of age; hence 
no examination was necessary.
I respectfully refer the papers for consideration of the Chief of the Board 
of Review.

DEPOSITION
Case of Julia A Harvell No. 729272
On this 9 day of Dec, 1902, at Oxford , county of Izard State of Ark, before 
me C. W. Freeman, a special examiner of the Bureau of Pensions, personally 
appeared J. H. Smith, who, being by me first duly sworn to answer truly all 
interrogatories propounded to him during this special examination of aforesaid 
claim for pension, deposes and says: I am a practicing physician and live at 
Oxford, Ark- I am a partner in the practice with my brother, J. L. Smith who 
is now absent from town on professional business.
I knew the late Julia A. Harvell who was an applicant for pension as the widow 
of the late Moses D. B. Harvell, who was a pensioner as a soldier of Co. H. 50 
Mo. V. Inf.  My said brother, J. L Smith, has done this practice for several 
years and was the attending physician in the last illness of said Julia A. 
Harvell widow of aforesaid- and she died on the 13 day of Sept. 1902, and her 
death was due to (unreadable word-interference??) of the bowels after an 
illness of about a week, as shown by our books.
Am not related or interested, have had the foregoing read and it is correct.
