This Indenture made and entered this 22nd of April 1835 between Thomas J
Kennedy of the one part and James Kennedy of the other part both of Giles
County and state of Tennessee Witnesseth that whereas the said Thomas J
Kennedy in the last will and testament of John Kennedy late of Giles County
deceased amongst other things is entitled as one of the devisees and
Legatees therein to certain real and personal estates described therein to
be possessed by said Thomas J Kennedy at the death of Sally Kennedy the
widow of said John Kennedy deceased and whereas the said James Kennedy by
the last will and testament of said John Kennedy deceased amongst other
things is entitled as one of the legatees therein to certain personal estate
consisting of many and other personal estate to be possessed and enjoyed now
immediately at this time by said James Kennedy. Now the said Thomas J
Kennedy for and in consideration of the said present interest of said James
Kennedy in said last will and testament had this day and does by these
presents grand bargain Sell alien convey sale off and confirm unto the said
James Kennedy his heirs and assigns forever all his right title interest and
claim in and to his said future share and interest both real and personal in
said estate of said John Kennedy by said last will and testament and the
said James Kennedy for and in consideration of the promises does likewise
and has by these presents granted bargained and sold aliened conveyed
assigned and transferred into the said Thomas J. Kennedy his heirs and
assigns all his right title Interest and claim in and to his present
interest in said estate of said John Kennedy deceased by said last will and
testament whether money property or goods of any sort and the said parties
do mutally promise covenant and bind themselves to and with each other to
warrant and forever defend the property by them respectively herein conveyed
in Witness whereof they have here set their hands and affixed their seals
the day and date above.

For the value of three hundred dollars to me in hand paid by William Kennedy
of Giles County Tennessee the receipt whereof is hereby acknowledged I have
this day and do by these presents sell transfer bargain and assign into the
said William Kennedy the sum and amount of three hundred dollars in the
personal estate of my father John Kennedy late of said county deceased which
is die and payable to me from his Executor the said Sum of three hundred
dollars here assigned is to be paid and due out of the share of James
Kennedy my brother by me heretofore purchased and now belonging to me In
Witness whereof I have here set my hand and Seal this the 16th day of October
1835

said William Kennedy his heirs and assigns forever all the right, title,
interest and claim, which I now have in and to the estate of my father. John
Kennedy deceased under his will or otherwise whether the same be real or
personal property.

and State of Tennessee for and in consideration of the sum of two hundred
and fifty dollars to me this day paid by William Kennedy the receipt whereof
is hereby acknowledged, have this day and do now by these presents grant,
bargain and sell, alien, convey, confirm, transfer and assign with the said
William Kennedy his heirs and assigns forever all my right, title, interest
and estate whatsoever whether real or personal, money, bonds or Negroes or
choses in action, which I as devisee or legatee under the last will and
Testament of my father John Kennedy late of said county deceased and
which will has been fully proven in the county court of said county, hereby
intending fully to convey to him the said William Kennedy his heirs and
assigns forever all interest and estate whatsoever I have or take in or
under said will. In Witness whereof I have set my hand and seal
March 4th 1837

There is a rather large inventory for John Kennedy's estate. On the first
page at the top of the inventory it says:
An inventory of the property of John Kennedy Deceased after the death of his
wife Sarah Kennedy this 3rd April 1838. Which leads me to believe that Sarah
(Britton) Kennedy died prior to April 3, 1838.

State of Tennessee Giles County - This Indenture made and entered into this
the 25th day of January eighteen hundred and forty three between Overton
Kennedy of the County of Giles and State aforesaid of the one part and
Alexander Kennedy of the County of Giles and State aforesaid of the other
part witnesseth that the said Overton Kennedy for and in consideration of
the sum of Eight hundred Dollars to me in hand paid by the said Alexander
Kennedy the Receipt whereof is hereby acknowledged hath granted, bargained,
sold, conveyed and confirmed into the said Alexander Kennedy three certain
tracts or parcels of land, they being in the county of Giles and State
aforesaid. Situate and being on the waters of Bradshaw creek. 1st Beginning
at a Locust tree on the west Bank of Bradshaw creek on Richard Smiths line
running thence north 35 degrees East one hundred and fifty six poles to a
Black Oak on William Polks line, thence west two hundred and ten poles to
two Lynns thence south twenty three poles to Buckey's thence south six poles
to a Stake, thence south thirty six poles to a cycamore on the west bank of
said creed and on said Richard Smiths line, thence south 45 degrees East
twenty three and � poles to a Stake thence north 68 degrees East twenty
eight poles to a Stake thence South 45 degrees East forty six poles to the
Beginning containing one hundred and Eleven acres more or less it being part
of a tract bought by Alexr M Corkleson of William Polk. 2nd Beginning on a
Beech running Eighty one poles East to a Red Oak Hence North twenty poles to
a hickory, thence twenty poles on a Beech at the Beginning containing ten
and a half acres more or less Thirty four poles to a Beech. Thence East
thirteen poles to an Elm and Hickory thence north forty two poles to a sugar
tree and Dogwood on said Thorpe's north boundry line, thence East with said
line one hundred and seventy eight poles to a Black Oak on the top of a
ridge Thence south twenty six poles to an Ash and Sugar tree thence west one
hundred and ninety one poles to the Beginning containing Eighty Eight and �
acres more or less. To have and to hold to the only proper use and benefit
of him the said Alexander Kennedy his heirs and assigns forever together
with all and singular the rights, tittles, and opportunities thereunto
belonging to or in any way wise appertuning and the said Overton Kennedy for
himself his heirs his Executors administrators doth covenant and agree to
and with the said Alexander Kennedy his heirs and assigns that the before
recited tract of land and bargained premises and every part and parcil
thereof he will warrant and defend to him their heirs and assigns forever
against the right, title claim and demand of all persons whatsoever claiming
the same either in law or Equity. In witness whereof I the said Overton
Kennedy have hereunto set my and seal the day and date first above written.

I Overton Kennedy of the County of Giles and State of Tennessee for and in
consideration of the Sum of one Dollar to and in had paid and for the other
considerations hereinafter mentioned have this day bargained and sold and do
hereby convey unto Alexander Kennedy his heirs and assigns the following
named property to wit, One large Black horse, one gray horse, one gray mare,
forty head of Stock hogs, one yoke of oxen, one ox cart, three milk cows and
calves, four head of Stock cattle, thirty head of geese, one cupboard and
furniture including a small Stock of dishes, one Mettal clock, one Bureau,
three Beds Bedsteads and furniture, one folding Table and nine bee hives. To
have and to hold all the said articles of property to the said Alexander
Kennedy his heirs etc. But this deed is made for the following uses and
trusts and for no other purposes, that is to say, I am indebted to Anderson
Alsip in the sum of one hundred by note due the 4th day of September 1843
and whereas the said Anderson Alsup is my security for the payment of the
three following notes to wit. One payable to John W. Smith Administrator of
W.G. Smith Dr. for $120.00 due 25th Dec 1841 with a credit of $50.00 on the
9th Jan. 1842. One other note payable to James Thorp Guardian of Nancy Smith
for ($60.00) Sixty Dollars due the 25 December 1842 with a credit of four
dollars ($4.00) 25 Dec 1842 and one other note payable to James Thorp
Guardian of Nancy Smith for Eight Dollars ($80.00) due 25 December 1843, on
which said three last notes I am the drawer of the said. Anderson Alsup is
my security and I am desirous to secure and make certain the payment of the
said note of one hundred Dollars due the said Anderson Alsup and also to
indemnify and save himself the said Alsup is my security against the payment
of the said other three notes above specified. Now thereupon if I should
will and truly pay of and discharge the whole of said debts by the first day
of February 1844 then this deed to be void. But if I should not them the
said Alexander Kennedy as Trustee after first giving twenty days notice in
writing in four of the most public places in writings in the district where
I live, shall sell said property at public sale to the highest bidder for
cash and apply the proceeds first to the payment of the necessary Expenses
and costs. Secondly to the payment of said several debts above specified and
thirdly to pay over the balance if any to me and it is Expressly agreed that
I am to retain the possession of said property and use the same until called
for, for the purposes of this Trust. Given under my hand and seal/ This
