Last Will and Testament |
Mecklenburg County Virginia In the name of God amen. I Daniel Daly of Mecklenburg County do appoint and ordain this testee as my last will of testament. Item: I give to my beloved wife ELIZABETH one feather bed and furniture of steed to her and her heirs forever. I lend to her one negro woman named VINEY during her life and after my wife's death should this negro be then living she may live with which of my three children she pleaseth; ELIZABETH; JOHN AND JONES. Item; I give and gequeath to my daughter ELIZABETH a tract of land lying on Planters Ferry Road bounded by James WATSON, Michael WORTMAN and is then by estimate eighty nine acres by the same or less, to her and her heirs forever. I also give and bequeath to my said daughter ELIZABETH two negroes namely JAMES and SARAH, one feather bed and furniture to her and her heirs forever also one sorrel mare, but, she is not to take the mare from the pantation until she raises the colt that she is in fole with. She is nnot to have the colt. Item; I lend to my beloved wife ELIZABETH all the residue of my estate both real and personal that I have in my possesion during her natural life or widowhood, after her marriage or death to be equally divided between my two sons, JOHN and JONES by three commisioners appointed by the courts. My debts to be paid out of the part I lend to my wife and my two sons JOHN and JONES to be schooled out of the same part of my estate I lend my wife. Item All the estat that shall fall to me hereafter out of my father's estate ..it is my will it shall be equally divided among my three children, ELIZABETH, JOHN and JONES. Lastly I appoint my beloved wife, my sons JOHN and JONES to execute this my last will and testament. In witness where of I have here unto set my hand and fixed my seal this TWENTIETH DAY OF FEBRUARY ONE THOUSAND EIGHT HUNDRED and SEVEN signed, sealed and published and delivered as and for the last will and testament of the above named DANIEL DALY in the presence of us ... James TAYLOR; Ludwell TANNER; John BUGG; John VANCE. DANIEL DALY seal At court held for Mecklenburg County the 13th day of JULY 1807 ... This will was proved by the oaths of JAMES TAYLOR; LUDWELL TANNER; and JOHN BUGG. witnesses there to and ordered to be recorded. ELIZAETH DALY the executrix there in refusing to take upon herself the burden of the execution thereof and on the motion of JOHN BUGG who made oath and together with JAMES NOLLY and RICHARD HUTCHISON his securities entered into and acknowledged their bond in th penalty of twenty thousand dollars, conditioned as the law dirests certificae is granted him for obtaining letters of administration of the said descendants estate with his will annexed in due form.
